Privacy Policy & Cookies

I. General provisions

  1. This Privacy Protection Policy sets out the manner in which personal data necessary for the provision of services by electronic means is collected, processed and stored through the website at the domain fenekmedia.pl (hereinafter: the Website).
  2. The controller of Users' personal data is Fenek Media Igor Opłatkowski, ul. Fryderyka Chopina 4/19, 88-200 Radziejów (hereinafter: the Controller).
  3. Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter: the GDPR).
  4. The data collected by the Controller will be:
    • processed lawfully,
    • processed for clearly defined purposes and not subjected to further processing incompatible with those purposes,
    • substantively correct and adequate in relation to the purposes for which they are processed,
    • stored no longer than is necessary to achieve the purpose of the processing.

II. Purpose and legal basis for data processing

  1. The Controller processes personal data necessary for the provision and development of the offered services available through the Website and its individual functionalities.
  2. Personal data will be processed for the following purposes:
    1. communicating with the User after completion of the contact form in order to provide them with the necessary information and to build positive and reliable relationships with them, which constitutes a legitimate interest of the Controller (Article 6(1)(f) of the GDPR);
    2. promoting by the Controller of its own products and/or services as well as those of its Partners by sending marketing Information (newsletter) by electronic means, provided that the User has consented to receiving such notifications via e-mail (Article 6(1)(a) of the GDPR);
    3. providing access to information about news from the industry directly related to the Controller's activity, provided that the User has consented to receiving such notifications via e-mail (Article 6(1)(a) of the GDPR);
    4. for analytical and statistical purposes on the basis of the Controller's legitimate interest consisting in verifying Users' activity and their preferences in order to optimise services and products and the functionalities used on the Website (Article 6(1)(f) of the GDPR);
    5. the potential establishment, pursuit of or defence against claims on the basis of the Controller's legitimate interest consisting in the protection of its rights (Article 6(1)(f) of the GDPR).
  3. In each of the cases listed above, providing data is voluntary but necessary to conclude an agreement or to use other functionalities of the Website.

III. Period of personal data processing

Data processed on the basis of consent will be processed until the consent given is withdrawn, with the reservation that the withdrawal of this consent does not affect the lawfulness of the data processing carried out prior to that withdrawal.

IV. Information about processing

  1. Depending on the purpose of processing, personal data may be disclosed to:
    1. entities affiliated with the Controller,
    2. entities cooperating with the Controller,
    3. subcontractors, in particular entities providing and operating selected IT systems and solutions,
    4. law firms.
  2. Personal data processed by the Controller will not be transferred outside the European Economic Area or to international organisations.

V. Rights of data subjects

  1. The Website User has the right to:
    • access to the content of their personal data,
    • rectification of data,
    • erasure of data,
    • restriction of data processing,
    • data portability,
    • object to processing carried out on the basis of the controller's legitimate interest,
    • withdraw consent at any time without affecting the lawfulness of the processing carried out on the basis of that consent before its withdrawal.
  2. The User has the right to lodge a complaint with the President of the Personal Data Protection Office in a situation where they consider that the processing infringes their rights and freedoms.
  3. The data processing does not involve automated decision-making, including profiling.

VI. Final provisions

  1. The Controller reserves the right to introduce changes to this Privacy Policy and at the same time guarantees that the Users' rights arising from this document will not be restricted.
  2. The User will be informed of any changes to the Privacy Policy by means of a notice available on the Website.

This Cookie Policy sets out the rules for storing and accessing information by means of Cookie files on the devices of a User using the Website at the domain fenekmedia.pl, whose controller is Fenek Media Igor Opłatkowski.

IV. Options for specifying the conditions for storage or access by means of Cookies
